    WRCU Testimony to the joint Indiana House and Senate Regulatory
    Flexibility Study Committee on the matter of the Bargersville Water
    Utility rate increase process

    On September 28, 2011 three representatives of WRCU testified to the joint Indiana
    House and Senate Regulatory Flexibility Study Committee on the matter of the
    Bargersville Water Utility rate increase process that took place in the summer of
    2010.  The utility had opted-out from Indiana Utility Regulatory Commission
    oversight in 1984, but only in 2010 had highly questionable decisions and actions
    become evident. WRCU, along with residents of Owensville IN (near Evansville) and
    Speedway, testified to the joint commitee in an attempt to stimulate legislation that
    would reign in municipal utilities which have opted-out from IURC control and take
    significant actions affecting users who do not live in the municipality.  
    Representatives David Frizzell and Kreg Battles have twice co-authored and
    presented such legislation.  They have been successful in the House but unable to
    get it through the legislative process in the Senate.  Our testimony hopefully will aid
    them in providing protections from predatory municipal utilities who do not have to
    subject themselves to voters.
